Here are some question we are asked about lien sales.

What is a lien sale?
Are you owed money for work or services performed, towing and or storage and no one has come to claim the vehicle? If so, then you need a lien sale. Be aware you only have fifteen days from the date work or services are completed to start you lien sale.

Who can do a lien sale?
Anyone, provided they do not have a finacial interest in the vehicle. A person who buys property that includes abandon vehicles cannot do a lien sale. They must contact their county abatement office or use the due diligent process for obtaining a title. We can help with that process.

How long does a lien sale take before I can sell or transfer the vehicle?
It depends on the value of the vehicle. If the value is less than 4,000 dollars, then you should be able to sell your vehilce in 31 to 41 days after notices are mailed. An over 4,000 dollar vehicle will take between 60 to 100 day to clear DMV and get an authorization to continue the lien sale. After that it is 20 days from the day of mailing, counting the date mailed, but not counting the day of sale. Also, you must hold the vehicle ten days after the sale to allow the legal owner (bank or finance company) additional time to get the vehicle.

The bank wants to reposess the vehicle, what do I do?
Great, that means the lien sale notices worked. As long as they can prove they are the legal owner OR prove they are the registered owner they can have the vehicle. Also they will need to all towing and storage to date.

Do I have to release the vehicle when I can make more money selling it at the lien sale auction?
Yes. As long as the person picking the vehicle can prove they are the Legal or Register owner, or represent them AND have all of the towing, storage and lien fees you are legally allowed to collect.

Someone opposed my lien sale, what happens now?
You must take them to court either to small claims court or superior court depending on the value of your claim. Have the court send the process service by certified mail. The person that opposed your lien agreed to accept service by certified mail when they opposed the sale. Should the piece be returned SAVE THEM UNOPENED and then contact us and we'll contiue the lien sale for you after the proper waiting period. Should the case go to trail be sure to ask for the judge to award you the car not a money judgement.
